Agreement and Scope

By accessing or using the Lexie website or the Lexie mobile application you agree to these Terms of Use. These Terms govern your access to and use of the marketing website at http://lexiefood.com and the Lexie mobile application that helps users manage ingredient intolerances and product allergies by scanning product barcodes and returning guidance based on Oxygen Labs product data.

These Terms apply to all users, visitors, and others who access the website or app. If you do not agree, do not use the website or app.

Use of the Website

Purpose: The website is a marketing and informational site that advertises the Lexie mobile application and provides general information about Oxygen Labs and Lexie features.

No Functionality Guarantee: The website does not provide the barcode scanning, product matching, or nutritional decision features available in the mobile application. Information on the website is provided for general informational purposes only.

Use of the Mobile Application

Functionality: The Lexie mobile application allows you to set ingredient intolerance and forbidden preferences to scan product barcodes. The app will indicate whether a scanned product is likely to be acceptable, should be avoided, or is forbidden based on Oxygen Labs product data and your settings.

Aid Only: Lexie is an informational aid only. It is not a substitute for professional medical, dietary, or allergy advice. You are solely responsible for decisions about products you touch, consume, or come into contact with.

User Responsibilities and Assumption of Risk

User Responsibility: You must independently verify product suitability before use or consumption. Do not rely solely on Lexie for safety-critical decisions.

Assumption of Risk: You accept all risk associated with using Lexie, including risks from inaccurate barcode matches, incomplete product data, changes in product formulations, labeling errors, or other inaccuracies. You must exercise caution and follow any instructions from healthcare professionals.

Disclaimers and No Warranties

No Warranty: Lexie website and mobile applications are provided on an as-is and as-available basis. Oxygen Labs expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, accuracy, completeness, reliability, and noninfringement.

No Guarantee of Accuracy: Oxygen Labs attempts to maintain up-to-date barcode mappings and product ingredient information but makes no guarantee that product data is current, complete, or accurate. Product formulations and labels change frequently and without notice.

Limitation of Liability

To the Maximum Extent Permitted by Law: Oxygen Labs, its officers, directors, employees, agents, affiliates, suppliers, and licensors will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for loss of profits, revenue, data, or goodwill, arising out of or related to your use of or inability to use the website or app.

Cap on Liability: Where liability cannot be excluded by law, Oxygen Labs' total aggregate liability for all claims arising from or related to these Terms or your use of the website or app will not exceed the amount you paid to Oxygen Labs for the app during the six months preceding the claim. If you paid nothing, liability is limited to a nominal amount.

Indemnification

You agree to indemnify, defend, and hold harmless Oxygen Labs and its affiliates from and against any claims, liabilities, damages, losses, and expenses arising from your use of the website or app, your violation of these Terms, or your violation of any rights of a third party.

Intellectual Property

Ownership: Oxygen Labs and its licensors retain all rights, title, and interest in and to the website, the app, and all related intellectual property, including trademarks, logos, text, images, and software.

Limited License: Subject to these Terms, Oxygen Labs grants you a limited, nonexclusive, nontransferable license to use the app on devices you own or control for personal, noncommercial use.

Third-Party Content and Links

The website or app may contain links to third-party websites, services, or content. Oxygen Labs does not control or endorse third-party content and is not responsible for it. Links are provided for convenience only.

Privacy

Use of the website and app is also governed by Oxygen Labs' Privacy Policy, which explains how we collect, use, and share information. By using the website or app you consent to the collection and use of information as described in the Privacy Policy.

Termination and Suspension

Oxygen Labs may suspend or terminate your access to the website or app at any time for any reason, including suspected misuse or violation of these Terms. Termination does not limit Oxygen Labs' rights or remedies.

Changes to Terms and Services

Oxygen Labs may modify these Terms or change, suspend, or discontinue the website or app at any time. Continued use after changes constitutes acceptance of the revised Terms. Oxygen Labs will post the updated Terms and an effective date.

Governing Law and Dispute Resolution

Governing Law: These Terms are governed by the laws of Australia without regard to conflict of law rules.

Dispute Resolution: Any dispute arising out of or relating to these Terms or your use of the website or app will be resolved in the courts located in Queensland, Australia, and you consent to the exclusive jurisdiction of those courts.

Miscellaneous

Severability: If any provision of these Terms is held invalid, the remaining provisions remain in full force.

Entire Agreement: These Terms and the Privacy Policy constitute the entire agreement between you and Oxygen Labs regarding the Lexie website and mobile applications.

No Waiver: Failure to enforce any right is not a waiver of that right.
